Malvern Panalytical Inc. and TA Instruments-Waters LLC Agree to Partial Settlement of Patent Infringement Lawsuit

Almelo, The Netherlands - Malvern Panalytical Inc. and TA Instruments-Waters LLC have agreed to a partial settlement of Malvern Panalytical’s patent infringement lawsuit against TA.

Malvern Panalytical sued TA Instruments-Waters LLC and its parent company Waters Technology Corporation (collectively “TA”) in 2019 for alleged infringement of five Malvern Panalytical U.S. patents. The parties agreed to settle their dispute with respect to three of the patents relating to certain automated features of isothermal titration calorimeters. Under the terms of the confidential settlement agreement, TA will receive a royalty-free license from Malvern Panalytical to those three patents.

Malvern Panalytical’s President Mark Fleiner said, “We’re very pleased to have reached this settlement with TA Instruments regarding the Broga family of patents. We believe it is the best possible outcome for everyone involved. We take pride in the innovative solutions we generate for our customers and protecting our intellectual property is critical in sustaining that innovative spirit.”
